These Terms and Conditions of Use (“Terms”) govern your access to and use of digital properties, internet sites, mobile-enabled sites, and software applications (“Software”) provided by Rogers Media Inc. (collectively, “Rogers Media Sites” or “Rogers Media Site”). Unless specific terms apply to certain Rogers products or services (“Services”), your use constitutes agreement to these Terms and any other relevant policies. If you do not agree, you may not use Rogers Media Sites. “Residents of Québec” refers to individuals subject to Québec`s Consumer Protection Act. Rogers Communications Inc. and its affiliates (“Rogers,” “us,” “we,” or “our”) reserve the right to modify these Terms at any time; your continued use signifies acceptance of such changes.
1. Introduction
Welcome to Rogers Media Inc.`s digital platforms, including websites, mobile sites, and downloadable software applications (“Software”), collectively referred to as “Rogers Media Sites.” By using these sites or any associated products/services (“Services”), you agree to these Terms and any other applicable policies. If you disagree, please do not use the Rogers Media Sites. Rogers, its affiliates, and subsidiaries reserve the right to modify these Terms, with changes becoming effective upon posting. Your continued use after modifications signifies your acceptance.
2. Registration, Accounts, Passwords
Some Services require registration or subscription. You must provide accurate and current information, updating it as necessary. Accounts are for personal use only, and Rogers generally permits one account per person. Multiple accounts by the same individual may lead to access restrictions or deletion. You are responsible for maintaining password confidentiality and for all activities under your account. Notify us immediately of any unauthorized use. You may be liable for losses caused by unauthorized account use. To delete your account, contact Rogers as specified in Section 22.
3. Access
Access to certain Rogers Media Sites or Services may require your digital device (computer, tablet, mobile, etc.) and internet connection to meet minimum technical requirements, which may change. You are responsible for updating your devices and connection as needed and for any data/roaming charges incurred.
4. Privacy
We respect user privacy. Our collection, use, and disclosure of personal information are governed by the Rogers Media Privacy FAQ. Personal information may be stored and processed in or outside Canada and subject to other jurisdictions` laws.
5. Ownership and Copyright
Rogers Media Sites and all content (text, images, audio, video, etc.) (“Content”) are protected by intellectual property laws and owned, controlled, or licensed by Rogers and its affiliates/licensors. All Content remains the property of its owner(s), and you agree to respect all associated copyright notices and restrictions. These Terms do not grant you rights to trademarks or logos; unauthorized use is prohibited. Rogers will enforce its intellectual property rights vigorously.
6. Content Usage Restrictions
Services and Content are for your personal, non-commercial use only. You may not reproduce, copy, translate, broadcast, display, sell, transmit, license, publish, or modify any Services or Content without prior written consent from the owner. Distribution of Content copies (including via email) is also prohibited without consent. You may, however, encourage others to access information directly on a Rogers Media Site.
7. Linking and Framing
Links to a Rogers Media Site homepage are permitted if they do not imply endorsement or affiliation with Rogers, nor damage our goodwill or trademarks. Rogers reserves the right to remove any such link. Framing or inline linking to any part of a Rogers Media Site is not permitted.
8. Other Contents and Links
You acknowledge that third-party content on Rogers Media Sites may be inaccurate, inappropriate, or offensive, and may include links to other sites. We do not control or take responsibility for third-party content. Accessing, transmitting, or downloading such content is at your own risk. Rogers is not responsible for products/services from advertisers or linked sites, which are independently developed. Links do not imply endorsement. Dealings with advertisers are solely between you and the advertiser. Rogers is not liable for content hosted on sites other than Rogers Media Sites.
9. Submissions and Postings
For any content you upload, post, transmit, or submit (“Contributions”), you must be the rightful owner or have permission. Contributions are treated as non-confidential and non-proprietary. By submitting, you grant Rogers a worldwide, royalty-free, perpetual, irrevocable, sub-licensable license to use, distribute, reproduce, modify, publish, and display your Contributions in any format, without compensation. You waive all moral rights. You warrant that your Contributions are free of claims, do not interfere with Rogers` rights, you are of legal age, and they are free of malicious software (viruses, etc.). Rogers has the right, but not the obligation, to monitor, investigate, access, preserve, move, remove, edit, delete, or refuse to post Contributions deemed unacceptable or violating laws or policies, without notice or liability. 10. Subscription Content
Certain Services require a paid subscription (“Subscription Content”).
- All prices are in Canadian dollars and are subject to change.
 - Agreement to Pay: You agree to pay for all subscribed content. Payments must be by valid credit card or charged to your Rogers bill. You authorize recurring charges if applicable. For free trials, your card will be authorized but not charged until the trial ends. Unresolved chargebacks will result in inaccessible content with no refunds. Rogers bill charges are governed by the Rogers Consumers Terms of Service.
 - Additional Terms: Specific Subscription Terms (e.g., subscription length, renewals) will be presented before subscribing and become part of your agreement.
 - Automatic Renewals: Unless specified otherwise, subscriptions automatically renew. We will notify you of renewal amounts and dates, and you can cancel by a deadline. If not canceled, you authorize automatic renewal charges.
 - Refunds: All Subscription Content sales are final; no refunds, exchanges, or credits.
 - Multiple users: Access may be limited to two or fewer simultaneous devices. Rogers may log off accounts exceeding this limit. You are responsible for third-party internet/data charges.
 
11. Software
- Restrictions: You are granted a license, not ownership, to the Software. You may not rent, lease, sell, sublicense, reverse engineer, decompile, disassemble, copy, modify, tamper with, or create derivative works of the Software. You may not circumvent any protection mechanisms.
 - 
Data Maintenance, Support, and Software Updates/Changes (if applicable):
- Rogers may, at its sole discretion, provide and terminate Support (upgrades, enhancements) without notice.
 - Rogers may collect non-personal information about your digital device(s) during Software installation/use.
 - Rogers may change, suspend, or discontinue any aspect of the Software or Services without notice or liability.
 - Rogers may impose limits on features or restrict access without notice or liability.
 - Rogers and its suppliers may delete data from servers or prevent access without notice.
 - Rogers is not obligated to provide new or additional Support.
 - Rogers and its agents may remotely access and run scripts on your Digital Device(s) for support purposes.
 
 - Multiple Users: You are responsible for ensuring all users of Software via your device(s) comply with these Terms and are liable for any breaches.
 
12. Prohibited Activities
Your use of Rogers Media Sites, Services, Content, and Contributions must comply with these Terms, all applicable laws, and our Acceptable Use Policy. The term “Services” in the Acceptable Use Policy includes those covered by these Terms.
13. Responsibility for Minors
If you authorize a minor`s use of Rogers Media Sites or Services, you are fully responsible for their access, use, and any misuse. You acknowledge some Content may be inappropriate for minors.
14. Suspension and Termination
- By Rogers: Rogers may restrict, block, suspend, or terminate your use of a Rogers Media Site, Services, or account without notice if you breach these Terms or any related policies. Termination does not relieve payment obligations.
 - Of the Service: Rogers may refund, suspend, or discontinue Services (or parts thereof) without notice or liability (subject to 14(c)). Your right to use Software terminates with the associated Service. Upon termination, you must delete the Software.
 - Subscription Content: Rogers may discontinue Subscription Content with 30 days` (60 days for Québec residents) advance written notice. You may terminate recurring subscriptions by notifying us as per Section 22. Termination is effective on the requested date or the date you notify us, whichever is later. (Not applicable to Québec residents: no refunds for uncompleted subscription periods.)
 
15. Indemnification
To the maximum extent permitted by law, you will defend, indemnify, and hold harmless Rogers and its affiliates, licensors, suppliers, and agents (collectively, “Rogers Parties”) from all claims, liabilities, losses, damages, costs, and expenses (including legal fees) arising from: (i) your breach of these Terms, Section 9 warranties, Subscription Terms, or Acceptable Use Policy; (ii) your use or misuse of a Rogers Media Site or Content, or your Contributions; (iii) your use or inability to use Software; or (iv) any intellectual property infringement by you or your account users. Rogers may assume exclusive defense at its own expense; you agree to cooperate. Indemnification survives termination.
16. No Warranties
All Rogers Media Sites, Services, and Content are provided “as is.” To the maximum extent permitted by law, Rogers Parties expressly disclaim all representations, warranties, and conditions, express and implied, including title, non-infringement, merchantability, fitness for a particular purpose, and those arising from trade usage. Rogers Parties do not warrant the performance, availability, accuracy, reliability, security, truthfulness, or completeness of the Sites, Services, or Content (including Software operation). Rogers Parties do not warrant that Sites or access will be continuous, error-free, or free from defects, viruses, or harmful components. You use Rogers Media Sites and Services at your sole risk.
17. Professional Information Disclaimer
Rogers Media Sites may offer “Professional Information” (e.g., law, finance, health). This information is for general purposes only, not advice, and should not be construed as an offer, solicitation, endorsement, or recommendation. It may not reflect Rogers` views and is not guaranteed for accuracy or completeness. We reserve the right to change or correct information without prior warning. Professional Information does not replace qualified professional advice. Your reliance on such information is at your sole risk, and Rogers and its affiliates are not liable for any related loss or damage.
18. Third Party Merchandise and/or Products
- We may receive commissions or fees on purchases made through or linked from a Rogers Media Site/Service.
 - Images of third-party merchandise/products on or through a Rogers Media Site/Service may not accurately represent their actual appearance or functionality.
 - Rogers Parties make no representations, warranties, or guarantees regarding third-party merchandise/products featured or available. All transactions are between you and the third-party seller/distributor/manufacturer, without Rogers` involvement. These third parties may have their own terms.
 - Nothing on Rogers Media Sites/Services constitutes an offer to sell third-party products. If you purchase them, Rogers Parties have no control over or responsibility for their quality, quantity, features, safety, legality, or the seller`s ability to provide them.
 - You agree that Rogers Parties are not responsible or liable for third-party merchandise/products featured or available on or through a Rogers Media Site/Service.
 
19. Limitations of Liability
- Not applicable to residents of Québec: To the maximum extent permitted by law, under no circumstances shall Rogers Parties be liable for:
- Any direct, indirect, incidental, special, consequential, economic, or punitive damages (including loss of profit, data, business opportunities, privacy breach, property damage, personal injury, death, or other foreseeable/unforeseeable loss) resulting from Support for Software, use or inability to use a Rogers Media Site/Services/Content, or transmission of confidential information. These limitations apply regardless of whether the party was aware of potential damages. You acknowledge Rogers Parties are not liable for defamatory, offensive, or illegal conduct by any user.
 - Any losses, claims, damages, expenses, or costs (including legal fees) arising from claims that Software use infringes third-party intellectual property or contractual rights. These limits apply to any act or omission of Rogers Parties, regardless of the legal doctrine.
 
 - Applicable only to residents of Québec: Except for damages resulting from a Rogers Party`s own act, Rogers Parties will not be liable for:
- Any damages (including loss of profit, data, business opportunities, privacy breach, or property damage) resulting from Support for Software, use or inability to use a Rogers Media Site/Services/Content, or transmission of confidential information. You acknowledge Rogers Parties are not liable for defamatory, offensive, or illegal conduct by any user.
 - Any losses, claims, damages, expenses, or costs (including legal fees) arising from claims that Software use infringes third-party intellectual property or contractual rights.
 
 
20. Arbitration
Not applicable to residents of Québec: To the extent permitted by law, unless otherwise agreed, any claim, dispute, or controversy arising from or relating to these Terms, Services, Rogers Media Sites, related statements/promotions, or resulting relationships, will be resolved by final and binding arbitration, excluding courts.
Not applicable to residents of Québec: Arbitration will be simplified and expedited by one arbitrator in your province of residence, under current commercial arbitration laws and rules. Rogers will cover reasonable arbitration costs. Arbitration will follow our Arbitration Protocol.
21. Other Important Terms
These Terms are governed exclusively by the laws of your province of residence; if outside Canada, by Ontario laws and applicable Canadian laws, without conflict of laws principles. You submit to Ontario courts` jurisdiction. Rights and remedies may vary by province. These Terms, as amended, along with applicable Subscription Terms and other referenced documents/policies, constitute the entire agreement. Failure to enforce any provision does not waive that provision or right. No waiver of any breach waives preceding or subsequent breaches. If any provision is void or unenforceable, remaining provisions remain effective; unenforceable portions will be construed to reflect original intentions as closely as possible. Course of conduct or trade practice will not modify these Terms. These Terms benefit and bind you, your heirs, representatives, and respective successors/assigns, and Rogers` successors/assigns. You may not assign or transfer these Terms without our consent; we may assign or transfer them without your consent. Sections 14-21 survive Service termination. If dissatisfied, your sole remedy is to stop using Rogers Media Sites. These Terms were drafted in English at the parties` express request. Acceptable Use Policy
Please direct any questions, comments, or violation complaints regarding this Acceptable Use Policy (“AUP”) to [email protected]. “You” and “your” refer to you and anyone using the Services through your account.
Introduction
When using our services, equipment, facilities, networks, and any associated products, content, applications, or services, you must comply with all applicable laws and our policies, rules, and limits, including this AUP. This AUP supplements and is incorporated into the Rogers Terms of Service (“Terms”).
IF YOU DO NOT AGREE TO BE BOUND BY THE TERMS AND THIS AUP, AS AMENDED FROM TIME TO TIME, YOU SHOULD IMMEDIATELY STOP USING THE SERVICES AND NOTIFY ROGERS OF TERMINATION.
Prohibited Activities
You may not (or allow anyone else to) use our Services to, without limitation:
- Use or disseminate unlawful content or content violating intellectual property rights.
 - Participate in illegal soliciting or gaming.
 - Attempt to use Services to avoid charges.
 - Engage in fraudulent activities, including impersonation or forging signatures. You assume risks regarding public domain material.
 - Access the Internet via Services using IP addresses not assigned by us.
 - Invade privacy, collect personal data, stalk, or harass.
 - Access confidential, copyright-protected, or patent-protected material without consent, or use tools like “packet sniffers” to facilitate unauthorized access.
 - Upload, publish, transmit, or distribute material protected by copyright or contractual rights without permission.
 - Use, reproduce, distribute, or exploit Services or content for commercial purposes.
 - Copy, distribute, or sublicense software or content provided by us, except as authorized.
 - Alter, reproduce, or tamper with Services or equipment identifiers (e.g., ESN, IMEI).
 - Restrict, inhibit, or interfere with others` Internet access or create unusual network burdens (e.g., distributing viruses, spam, generating excessive traffic).
 - Disrupt network nodes or services, or impede our ability to monitor or deliver Services.
 - Interfere with computer networking or telecommunications services (e.g., denial of service attacks, “hacking,” attempting to “crash” a host).
 - Use Services for non-personal purposes (e.g., reselling) or share/transfer Services without consent.
 - Operate a server in connection with Services (e.g., mail, web, chat servers, multimedia streamers, interactive forums).
 - Impersonate any person or entity, including a Rogers official.
 - Forge headers or manipulate identifiers to disguise content origin.
 - Port scan without consent, or use tools designed for such scans.
 
Unlawful or Inappropriate Content
Any Rogers Party may move, remove, or refuse to post content deemed unacceptable, undesirable, or violating the Terms or this AUP, including, without limitation:
- Obscene, profane, or pornographic content.
 - Defamatory, fraudulent, or deceptive statements.
 - Threatening, intimidating, abusive, or harassing statements.
 - Content violating privacy or intellectual property rights.
 - Content unlawfully promoting or inciting hatred.
 - Otherwise offensive or objectionable content.
 - Transmissions encouraging criminal offenses, civil liability, or violating laws/regulations.
 
For this AUP, “content” includes text, graphics, executable programs, audiovisual recordings, and audio recordings.
Security
You are responsible for any misuse of Services by yourself or others through your account/equipment. You must prevent unauthorized access (e.g., via wireless/wired networking). Services may not be used to breach security, gain unauthorized access to others` equipment/data, or circumvent authentication. Use or distribution of security-compromising tools (e.g., password guessing, cracking, packet sniffers) is prohibited. You may not disrupt Services or interfere with computer networking/telecommunications. Transmission of viruses or harmful software is prohibited. You are solely responsible for device security, including stored data. Rogers recommends against file/printer sharing and advises strong passwords for remote access. Treat all access codes, PINs, and passwords as confidential.
Unsolicited Communications
Services may not be used for unsolicited, bulk, or commercial messages (“spam”) or other unsolicited communications. This includes automatic dialing, mass mailing, or sending messages to individuals who have opted out. Services may not be used to collect responses from unsolicited emails sent from other internet hosts/services that violate this AUP or other ISP acceptable use policies. Unsolicited emails may not direct recipients to web sites using Services. Forging/altering email headers is prohibited. “Mail bombing” (sending numerous/large messages to disrupt an account) is prohibited. Propagation of chain letters is also prohibited. Rogers is not responsible for forwarding email to suspended/terminated accounts; such email may be returned, ignored, deleted, or temporarily stored at Rogers` discretion.
User-Generated Content Services
“User-Generated Content Services” (“UGC Services”) refer to online services allowing users to post, upload, or generate content for sharing (e.g., newsgroups, forums, blogs, video sharing).
